The national framework that applies everywhere in India

Regardless of which state or union territory you are in, a de-addiction or rehabilitation centre typically sits under some combination of these. Read this section once; it does not change by state.

Mental Healthcare Act, 2017 (MHCA)

Its definition of mental illness includes mental conditions associated with the abuse of alcohol or drugs. Because of this, most centres offering inpatient or residential care need to register as a Mental Health Establishment (MHE) with their State Mental Health Authority (SMHA) under Section 65. Purely outpatient counselling-only services are often exempt, but this varies by state. Operating an unregistered inpatient MHE carries a penalty under Section 107(2).

NDPS Act, 1985 and NDPS Rules, 1985

Section 71 allows the government to establish or recognise centres for treatment and supply of narcotic drugs to registered addicts. Several states have used this as the legal basis for their own de-addiction centre licensing rules. Buprenorphine, the medicine most Indian centres actually dispense, is governed by state-specific rules or general NDPS and Schedule H1 controls rather than the central Essential Narcotic Drugs list.

Clinical establishment or nursing home registration

Separate from MHCA registration, most states require any facility providing inpatient medical care to register under the state's clinical establishment or nursing home law, or the central Clinical Establishments (Registration and Regulation) Act, 2010 where adopted.

NAPDDR, for government funding

The Ministry of Social Justice and Empowerment's National Action Plan for Drug Demand Reduction funds NGOs running Integrated Rehabilitation Centres for Addicts (IRCA), Community Peer-Led Intervention centres (CPLI), Outreach and Drop-In Centres (ODIC), and District De-Addiction Centres (DDAC), typically covering up to 90 percent of approved expenditure (95 percent in North-Eastern states, Sikkim, Jammu and Kashmir, and Ladakh).

NACO and the State AIDS Control Society, for government-recognised OST

If you want to run an Opioid Substitution Therapy programme under the national HIV harm-reduction umbrella, accreditation runs through NACO and your State AIDS Control Society under a separate set of operational guidelines.

What is specific to Mizoram

Mizoram records some of the country's highest rates of opioid use in the Ministry of Social Justice and Empowerment's national substance use survey, and maintains NAPDDR-supported IRCAs, CPLIs and ODICs across the state, including through regional NGO networks operating across the North-East.

As a North-Eastern state, NAPDDR grant-in-aid for eligible NGOs runs at up to 95 percent. Confirm current registration requirements directly with the Mizoram Health and Family Welfare Department.

Government hospital-based

ATF

Addiction Treatment Facility inside a government hospital or medical college, under the Ministry of Health and Family Welfare's Drug De-Addiction Programme.

Prevention only

CPLI and ODIC

Community Peer-Led Interventions and Outreach and Drop-In Centres handle prevention, early identification and harm reduction. They are not licensed treatment beds.

Outpatient, medication-based

OST / OOAT centre

Opioid Substitution Therapy, prescribing buprenorphine-naloxone under medical supervision. Needs drug-handling authorisation on top of any general de-addiction licence.

Private, for-profit

Private de-addiction centre

Residential or outpatient, self-funded. Needs Mental Health Establishment registration, clinical establishment registration, and an NDPS-linked licence if it dispenses controlled substances.

Combined care

Psychiatric nursing home with SUD services

A general psychiatric facility that also treats substance use disorder alongside other psychiatric illness.

Long-stay, non-medical

Counselling-cum-Rehabilitation Centre

Prolonged counselling and rehabilitative support without necessarily providing acute medical detoxification.

Step-by-step to open a centre in Mizoram

  1. Decide your scope first. Detox-only short stay, long-stay rehabilitation, OST/OOAT dispensing, or a combination. This decides which licences you actually need.
  2. Confirm with the Mizoram State Mental Health Authority whether any state-specific de-addiction rule exists beyond the general Mental Healthcare Act, 2017 process. Public information on this is limited for Mizoram at the time of writing, so a direct enquiry is the most reliable route.
  3. Line up your qualified staff before you apply. Most state frameworks expect a full-time or clearly designated psychiatrist to oversee treatment, particularly for any medication-assisted treatment, plus a minimum counsellor-to-patient ratio.
  4. Register the premises as a clinical establishment or nursing home with the relevant state or UT health department, meeting physical infrastructure, fire-safety and bed-density standards.
  5. Register as a Mental Health Establishment with the Mizoram State Mental Health Authority, submitting Form B under the Mental Healthcare (Central Mental Health Authority and Mental Health Review Boards) Rules, 2018, along with any minimum-standards documentation your state has published.
  6. Apply for a de-addiction or OST-specific licence if you intend to store or dispense controlled substances, typically requiring a documented supply chain, a locked and logged stock register, and a patient dispensing register.
  7. Set up your record-keeping before your first patient walks in. A patient registry, stock register, dispensing register, and periodic returns to the licensing authority are usually named directly in licence conditions, not optional add-ons.
  8. Register on the Health Facility Registry under ABDM. Increasingly expected by inspecting authorities and referral networks, even where not yet mandatory.
